DATA PROTECTION

GDPR & KVKK Notice

Detailed information for data subjects under the EU General Data Protection Regulation and Türkiye’s Law No. 6698 on the Protection of Personal Data.Effective date: 26 October 2026
Terms of UsePrivacy PolicyCookie PolicyGDPR & KVKK Notice

1. Controller and privacy contact

Controller: Europa Climate İklimlendirme Sanayi ve Dış Ticaret Limited Şirketi. Address: Fatih Mah. 66. Sok., Gürfer Sanayi Sitesi No: 7A, Kapaklı / Tekirdağ, Türkiye. Authorized privacy contact: Berat DURAK, +90 850 606 01 09, info@europaclimate.com. Requests may be submitted in Turkish or English.

2. Processing principles

Personal data is processed lawfully, fairly and transparently; collected for explicit and legitimate purposes; limited to what is relevant and necessary; kept accurate; retained only for the required period; and protected through proportionate security measures. These principles reflect GDPR Article 5 and the core principles of Law No. 6698.

3. Processing activities

Website and business-contact processing may include collecting contact and project form fields, responding to product or project requests, maintaining customer communication, presenting relevant products, preparing quotations, maintaining correspondence, protecting infrastructure, measuring site performance, administering consent, meeting legal obligations and defending legal claims. Recurring promotional communications and optional advertising or analytics processing are separated from essential operation and activated according to the visitor’s preference.

Website and form correspondence records are stored on Europa Climate servers hosted at the Datacasa Tier 3 data centre, Kayabaşı Mahallesi, Ulubatlı Hasan Caddesi, D Blok No:3, 34494 Başakşehir/İstanbul, Türkiye. The form records whether the optional product-information choice was selected so that the preference can be demonstrated and respected.

4. Legal grounds

The legal ground depends on the activity.

  • Consent: recurring product introductions and commercial communications selected through the optional form control, plus optional analytics, advertising, remarketing and similar device storage where consent is required.
  • Contract and pre-contractual steps: responding to a contact form, quotation request or project assessment.
  • Legal obligation: tax, accounting, regulatory and official information requests.
  • Legitimate interests: proportionate B2B customer communication, network security, fraud prevention, relationship management and service improvement, after balancing against individual rights.
  • Legal claims: establishment, exercise or defence of a right.

5. Transparency at collection

At or before collection, we provide the controller’s identity, purposes, legal grounds, recipient categories, collection method, international transfer information, retention approach and applicable rights. Consent requests are presented separately from this notice and are not bundled into acceptance of unrelated services.

6. GDPR rights

Where GDPR applies, Articles 12–22 may provide the following rights:

  • Access to personal data and a copy of relevant information.
  • Correction of inaccurate or incomplete data.
  • Erasure where no overriding ground requires continued processing.
  • Restriction of processing in the circumstances defined by law.
  • Data portability for eligible automated processing based on consent or contract.
  • Objection to legitimate-interest processing and an absolute right to object to direct marketing.
  • Withdrawal of consent at any time for future processing.
  • Protection against solely automated decisions producing legal or similarly significant effects.
  • Complaint to the competent supervisory authority and an effective judicial remedy.

7. KVKK rights

Under Article 11 of Law No. 6698, data subjects may learn whether data is processed, request information, learn the purpose and whether data is used accordingly, know recipients in Türkiye or abroad, request correction, request deletion or destruction when conditions are met, request notification of correction or deletion to recipients, object to adverse results arising from analysis exclusively by automated systems, and claim compensation for unlawful processing damage.

8. How to submit a request

Send a signed written request to Fatih Mah. 66. Sok., Gürfer Sanayi Sitesi No: 7A, Kapaklı / Tekirdağ, Türkiye, or email info@europaclimate.com with the subject “GDPR/KVKK Data Subject Request”. You may contact Berat DURAK at +90 850 606 01 09 for procedural assistance.

  • State your name, contact details, relationship with Europa Climate and the right you wish to exercise.
  • Describe the relevant interaction, date range, email address, device or request so the records can be located.
  • Provide proof of authority if acting for another person.
  • Do not send unnecessary identity documents; we will request only proportionate verification.

9. Response procedure

Requests are logged, identity and scope are verified, relevant systems and recipients are searched, and a reasoned response is provided within the applicable statutory period. GDPR requests are normally answered within one month, subject to lawful extensions for complexity or volume. KVKK applications are answered as soon as possible and no later than thirty days. Fees are charged only where legally permitted.

10. International transfers

Where data is transferred internationally, Europa Climate evaluates the destination, recipient and transfer mechanism. Transfers subject to GDPR use Chapter V safeguards; transfers subject to KVKK follow Article 9 and applicable Board procedures. Provider access is limited by contract, configuration and data minimization. Consent for optional trackers does not replace any mandatory transfer safeguard.

11. Consent management

Consent is specific, informed, freely given and demonstrated by an affirmative action. Analytics and marketing choices are separate, refusal does not prevent access to core website functions, and withdrawal is available through the “Cookie Settings” control in the footer. The site records the consent version and categories selected for compliance purposes.

12. Complaints

You may first contact Europa Climate so the matter can be investigated. This does not limit your right to complain to the Turkish Personal Data Protection Authority or, where GDPR applies, the supervisory authority of your habitual residence, workplace or place of the alleged infringement.
